August 8, 2016 was a heavy day for the vape industry. The much-dreaded FDA Deeming Regulations went into effect, and many critics saw the doom of the entire vape industry. These regulations lumped vaping products under the umbrella of “Tobacco Products.” Though Mt Baker Vapor saw some challenges, we have weathered the storm. Here’s an update of what’s changed about our company since the Deeming Regulations went into effect:

Here’s our official statement when the Deeming Regulations were announced:

On May 10th, 2016, the FDA finalized their Deeming Regulations regarding the vaping industry. These regulations have been in formulation for over three years, and deem vaping products as tobacco products in the eyes of one of the nation’s largest regulatory bodies.

To call these regulations heavy-handed would be an understatement. While the FDA says they want to bring vaping products under the same regulatory standards as other tobacco products, these new regulations go far beyond that initial goal. If the regulations are implemented as currently written, the industry as we know it will be decimated. As a company, Mt Baker Vapor is committed to doing everything possible to keep this from happening.

Founded in July of 2015, The Right to be Smoke-Free Coalition (R2BSF) is dedicated to challenging all unconstitutional state and federal laws related to the vaping industry. The founding members of the coalition include Cosmic FogNicQuidVapor Shark, and Mt Baker Vapor. As the fight against these harsh regulations evolve, the coalition will play a key role in organizing and funding industry activities.

We will utilize our positions as leaders in the industry to defend the rights of the entire vaping community. The FDA regulations are being contested, and we are already taking the necessary steps to legally challenge them. We will also be reaching out to members of the community to join the R2BSF coalition to challenge this blatant overreach of governmental power.

As a member of the Mt Baker Vapor family, we ask that you take action NOW to let your representatives know that you stand for reasonable vaping regulations. See the link below to express support of HR 2058, a bill which will change the “grandfather date” for deemed tobacco products. This revision would allow for all vaping products currently being sold to remain on the market without being subject to the FDA’s premarket application process.

Please keep in mind that, while the regulations are now public, Mt Baker Vapor is continuing business as usual. All the e liquid, hardware, and DIY supplies you have come to know and love are still available for purchase and will be available for the foreseeable future.

The Aftermath:

Immediately, Blue Check Age Verification was implemented on our site, to make sure absolutely no minors could get through our checkout process. This was an adjustment period for many of our customers, but they persevered.

We enjoyed some exciting innovation, internally. Solar Panels were successfully installed to augment our power, while reducing our environmental impact. Our automated process has maximized manufacturing efficiency and consistency, allowing us to precision-batch larger quantities of e liquid.

We’ve continued to challenging the FDA’s Deeming Regulations via R2BSF, advocacy content across the internet, and spreading the good word of HR 2058.

In summation, we’ve advocated for the future of the vaping industry, adapted some processes, and tightened our practices to be as compliant as possible. All the while, we’ve continued to offer competitive prices on our products, with the best customer service in the business, and hasty shipping.   1. It would be humorous were it not so sad that the FDA still insists that there is no proof that vaping helps people stop smoking cigarettes.

    MBV, along with all the other vape-related companies, are David to the Goliath that is the tobacco and pharmaceutical industries who sit with the FDA comfortably in their pocket.

  3. Is there really a chance of us winning against the machine?I will always fight but it seems like a battle that can’t be won.

  4. Well, as a very long time customer who relied on you I think you failed big time.
    First of all, there are no “regulations” being enforced at the moment. So by pre-empting you may or may not being making a good gamble. Not sure your volume sale but your profits are higher now that you effectively doubled the price but then threw a bone by giving a “bulk” bonus? Still makes it 1/3rd higher price.

    I tried to weather the non-existent storm you swore is coming and no more. I’ve finally found a suitable flavor to replace my favorite Mt. Baker. For the same price and in bulk.

    Wish it didn’t come to this, but i’m suspicious you’re on the side of big regulation. A sheep in wolf’s clothing so to speak. You are a business that obviously could weather the storm where a lot of B&M’s and boutique operations will not. Weeding out the competition. You seem rather well connected and doing well. Totally would be a shame if that’s your business model. Not saying you are, but it is very suspicious. Prices should not be going up but down due to demand, but with the excuse of Big Brother, another company has found a way to do the opposite at the expense of customers. This has happened in almost all industries so it’s not unreasonable to say it’s happening here.

    I’ll check in from time to time as I really think your products are top notch, but just overpriced at the moment and I will not bad mouth you if someone is looking to quit smoking using vaping.
